Navigating the Nigeria Climate Change Act 2021: A 2026 Practitioner Guide for Youth, NGOs, and Enterprises

In 2026, navigating a Nigerian green economy policy requires moving past high-level federal promises down to actual operational mechanics. For 16 years at Clement Isong Foundation (CIF) in Uyo, Akwa Ibom State, I've watched environmental policies gather dust in Abuja while host communities in Ibeno and Esit Eket bear the costs of climate damage.

The statutory framework changed when the Federal Government operationalized the enforcement rules under the Climate Change Act 2021. The Secretariat of the National Council on Climate Change (NCCC) now collects statutory revenues, issues carbon project approvals, and regulates carbon offset protocols across Nigeria.

This analysis details how youth, civil society organisations, and small green enterprises can navigate the legal mechanics, compliance processes, and funding flows established by this framework.

The Statutory Framework and the National Council on Climate Change

The Climate Change Act 2021 serves as the primary legal instrument driving national decarbonisation and climate adaptation. Section 3 of the Act establishes the NCCC under the Presidency, giving it sole authority to set national carbon budgets, approve offset projects, and administer climate finance mechanisms.

Section 15 of the Act creates the Climate Change Fund. This fund pools finance from three primary sources:

  1. Carbon tax charges levied on heavy industrial emissions and fossil fuel extraction.
  2. Penalties paid by oil and gas companies for illegal gas flaring under National Environmental Standards and Regulations Enforcement Agency (NESREA) regulations and Petroleum Industry Act (PIA) provisions.
  3. Sums appropriated by the National Assembly for climate mitigation and adaptation programs.

Section 26 empowers the NCCC to regulate national carbon market operations. By 2026, the NCCC operationalized the National Carbon Market Framework, making registration mandatory for any organisation claiming, trading, or generating carbon credits within Nigerian borders.
